A Woman’s & Pregnant Person’s Right to Choose

Abstract

Through the ruling of the unconstitutional action 148/2017, the National Supreme Court of Justice analyzed the constitutionality of some articles of the Penal Code of the State of Coahuila de Zaragoza that regulate the crime of abortion. The Court decided that some of the norms which were questioned are contrary to various rights of women and pregnant people such as the one to decide and to human dignity and equality, by criminalizing them for interrupting pregnancy, are the reason why the Court invalidated them. By resolving this matter, the Court established a functional precedent for the entire country that, for the first time, recognizes a prohibition of criminalization of women and people with the capacity to gestate who decide terminating a pregnancy.
