THE CONSTITUTIONAL RIGHT TO STRIKE AND THE MODERN LAW ON FREEDOM OF ASSOCIATION

In view of free trade and the relentless challenges of the global economy, it has become interesting to gain insight on the constitutional foundations of the trade-union laws on the Mexican legal system. Hence, the protective and vindicatory essence of its social principles is analyzed regarding particularly its three key figures: the right to unionization, the professional negotiation and of course, the strike. In this sense it is discussed, that based on our constitutional principles, the neo-liberal hype, and the monetarist contra revolution have been factors fueling, as curious paradox, the solidarity awareness of workers, unity of articulated action and union resistence.
